Hit and run incident
Ok so this is the most ridiculous thing i had to deal with
Someone had hit my vehicle and drove off i know who it was and my dash cam clearly shows thats the vehicle which was parked on the right side of where they hit while pulling out of the parking bay
The police has obtained the cctv from the parking location
After a several weeks i got an update from them which they stated cctv footage quality was not that great how can it not be great it is at a expensive hotel car park and the cctv is not even 5 to 6 meters away
Also the footage will show how many cars had parked next to mine which was definitely none
Also you would be able to see the damaged area change shape and colour before the vehicle pulls out and after and the parts of the vehicle on the floor
I was given the addressee of the vehicle registered owner found the vehicle and took pictures of the damage area which is very bad on theirs and obvious from the Angle and location of the area of the damage
All my insurance is stating oh we are in a difficult situation if we cant provide cctv footage of the incident we cant do much
But wait a minute i have given you solid proof with the damage images of the vehicle and also you have the cctv footage which police have
The third party has nothing
What is my stance on this what can i do any suggestions

Does your dash cam show the reg number?

Have you seen the cctv footage?0
-
Yes the dash shows the reg number when am parking next to it and no they did not give me the footage due to gpdr laws0

So to be clear, your dash cam only shows the details of the car that you park next to but doesnt catch the collision itself? Does it capture that car leaving or any others coming/going?
Who is “they” in your request for the footage? The Police or the Hotel? You could attempt a DSAR request for a copy of the CCTV footage but the chances are if they have refused a general request they will refuse a regulatory request because of the fact others can be identified in the footage.
The police have a higher burden of proof and lets be honest, arent interested in a minor property damage once details have been exchange even if it is a “hit and run”. Without seeing the CCTV its obviously pure speculation on the quality... the fact its in an “expensive hotel’s car park” I can certainly say has little correlation to the video quality. I’ve seen hundreds of CCTV videos of car crashes over the years from petrol forecourts to “6 star” hotels and most were useless and some of the most budget areas had the best quality footage (probably most drive offs without paying for fuel etc).
Ultimately it is at your insurers discretion on how far they want to take it, how much they are willing to pay for editing of video that the police have already dismissed as poor quality etc if you leave it in their hands.
Other option is to pay for the repairs yourself and then sue the driver of the other car... which is the other problem... you have to litigate against the driver not the registered keeper.0

Problem then is i cant know the driver of the car only the registered keeper and i dont have the cctv footage to identify who the driver is
Yes the dash cam only records while driving and not while its parked
Its just beyond me on how the law works hit and run is a criminal offences yet the police does not care at all
And the third party has no proof of the collision yet the damage on the vehicle states otherwise0

Its how the law is enforced, because its only property damage and cars have their insurances in place etc its seen as not a good use of police resources and ultimately the insurances will sort out the property damage. The reality of a police force with finite funding and the majority of people wanting to pay less taxes not more.gt1990 said:Its just beyond me on how the law works hit and run is a criminal offences yet the police does not care at all

Have your insurers at least gotten a statement from the TP? I’d assume they will say they left and at that point neither vehicle was damaged or that their damage predates their parking there. If its the former have they said how the current damage did happen?0

The fact that their car is damaged won't help, they will just say they hit someone else or a wall.
I'd keep trying to get the CCTV. Lots of places use GDPR a an excuse because they can't be bothered or don't want to do the work for free. They should be able to edit the bit you need down, at a cost which you could recover later. It's a gamble, it might not help but it's your only hope.0

They have said nothing yet and waiting for the third party to get back to themSandtree said:

Are you currently claiming for your damages from your insurance or are you awaiting liability?gt1990 said:

One of the issues that people come up against is that most insurers will take limited actions whilst they aren’t paying out for your damage (or being approached by the TP holding you liable); their rights crystallise once they’ve indemnified you0

I am awaiting liability, i understand that but then whats the point of having a insurance company and paying them for their services if they can't defend me to the fullestSandtree said:
