Court report: F8QZ50RN VCS v MR S (North Shields) VCS put in evidence, photos with the wrong year!

This from a PPC-fighter contact off-forum:

This case was about a visitor to a block of flats. A visitor permit needed to be displayed but the visitor was not given time to get the permit from the resident before the VCS warden issued a ticket.

In our WS the we attacked both the NTK not being compliant with POFA,(driver not identified) and additional add on costs but the most important issue was the photographic evidence submitted by VCS which showed the vehicle parked in a visitor bay with no permit on 23/2/2015. The parking event was actually 23/2/2016. 

There was a telephone hearing in September in which the DDJ Furness allowed VCS to submit further evidence, even though we had attacked the false instrument issued by VCS in the WS.  

A supplementary WS was issued by a different paralegal for VCS, in which they stated a mistake was made by the warden who had merely input the wrong date. No statement from the warden was attached to the WS

At a further hearing, held on the phone, on Friday 11th December,  heard by DDJ O'Donnell, the VCS rep seemed very cocky and thought he would walk all over D even though he was very unorganised and had no WS from D or C and clearly had no knowledge of the case.

DDJ O'Donnell spent 5 mins ripping him to shreds about their incompetency, stating not to bring cases before him again with this type of evidence.

Claim Dismissed - no costs awarded as it was a telephone hearing.

    Jake seems to have gone quiet.
    Maybe the "man who would be king"  has told him not to be so stupid ?

    If the warden can input the date on the photos, presumably they can also input the times?

    Trouble with the VCS model, is that SRS fires the starting gun, and foolishly relies on others to do his dirty work.

    As they say ... "if you want a good job doing ... do it yourself"

    You never know how far you can go until you go too far.

    He may have been good at clamping but the employment review sites are not very complementary about the management skills of the directors of VCS and Excel.

    They have been described very eloquently as a s--t stain on society.
