COURT REPORT - COASTWAY VETS PREDATORY TICKETING, NO GRACE PERIOD - OPS LOSE AT BRIGHTON COURT AGAIN

Well done Coupon-mad and Parking_Mad.
I guess that in comparison to some of the family cases that District Judges and Deputy District Judges deal with these parking claims seem very trivial. They are not trivial to the individuals who have had months of being harassed. They are not trivial to the residents who are hassled for parking in spaces where they have every right to park.

What on earth ore Coastway vets doing in allowing this company to operate on their behalf??Out of the back of this, would/are Coastway vets be in any way liable for any costs/ separate action over the behaviour of their agents?2

Coastway vets are responsible for this sort of crap for years, including when they used to let a previous incarnation of OPS (I think, or may have been another nasty clamper firm) clamp and demand money immediately, before 2012. I recall reading a clamping article about that place and think one of my builders who was working at my cottage last year told me he had his car clamped there by some thug, years ago.
This really is no better.
I did wonder if Coastway vets have a family connection or something to a PPC Director because it's madness and a bullying mentality (not normal business operation for most shops, vets, etc) to let this sort of crap go on for over ten years as if it's normal, instead of just putting 'RESERVED' or 'PERMIT HOLDERS - VETS ONLY' on the tarmac and/or a sign on the red posts that already exist in front of every bay.
Coastway vets should be ashamed. BTW one of their signs has fallen off the wall, the Defendant tells me, and hasn't been replaced in months.

The thing is, these parasitic parking companies will just continue to prey on people for as long as landowners allow them to.Even when a PPC looses in court, in the long term its a win as they can claim they take people to court - and the threat of court action is enough to scare people into paying up.Planes that allow un regulated predatory parking companies to operate on their land should be made fully responsible for the actions of these PPCs, even more so if there has been previous issues4

Which is why we are awaiting the new parking CoP from the Mhclg3

Thanks so much for this post. That's my vet and I have many times parked there to use the vet (and may, on a quiet day, have nipped v quickly to Aldi when appointments are running late) .. I had no idea! I must have been lucky thus far ...

I would never, EVER park where OPS infest. Look for their illegible signs; they are all over Sussex like a rash.
Stanmer Park and all the housing contracts are the worst ones apart from this place and Eastgate Wharf, Lewes.
You know you can park in Aldi's car park round the back and DON'T have to just use Aldi? The Planning permission allows it. Be careful about time though because Aldi is infested by ParkingEye (ANPR cameras) so you must stay under the pathetic 90 mins that P/Eye squeezed the 3 hrs down to. We know this, because it's the infamous 'Portslade Aldi' where ParkingEye put signs up saying 'Aldi customers only' (Council told them to take that down once tipped off by a regular poster here at the time - not me) and then they sought to apply and re-apply to the local Council until they wore them down, to erode the 3 hour time limit (applications were ''in Aldi's name'' but written in ''ParkingEye-speak'' about footfall and other meaningless stuff that sounds like it makes sense).PRIVATE 'PCN'? While it is rare to award costs in a small Claims case (there has to be a finding of unreasonable behaviour [CPR 27.14(2)(g)] the Defendant is entitled to his expenses for coming to Court including travelling, parking and loss of earnings up to a maximum of £95. I'm surprised that the Judge didn't award them.2
