Making a court claim to multiple ltd companies

There is no track of the court system where you are guaranteed to get all your fees paid if you win; the law gives judges discretion and even in multi-track the costs must be both reasonable and proportionate... you cannot spend £1m in legal fees to try and reclaim £30k of losses and expect to get an award of £1.03mloveka said:The fast track is costly and sometimes judges don't even award you all your costs even of you win.0 -
Very sorry to read this.loveka said:I am in a very similar situation to you in that I bought a caravan which is not fit for purpose. I have lost about 17k.
I bought it from a limited company and I have been advised by a consumer law specialist solicitor that there is no point pursuing it through the courts. Even if ( and it is actually when as I am 100% sure I would) I won I would not be able to actually get the money or costs as they would simply close the business down to avoid paying. So I would be throwing even more money away.
The fast track is costly and sometimes judges don't even award you all your costs even of you win.
It is a hard pill to swallow and I'm feeling pretty low about it. The law really is an !!!!!!.
Unless you've been affected by a rogue caravan dealer, its hard to understand i think. There is no legislation, no Ombudsman unless you still have outstanding finance, and solicitors won't touch it because the chance of being paid is minimal to say the least.
