Argos could not supply item, goods paid by egift from 3rd party, refund possible??

Hi, My partner works for a business that gives a  discount to buy stuff from leading retailers, so ordered some goods from argos as click and collect, the payment was taken by a  third party company who then must have paid argos, after nearly 14 days from time of the online order the item was not still delivered to the store for collection, and we found out that argos no longer sell the item, so we cancelled the order, thinking we would get a  refund back to our debit card and now we have an egift card to use for £173.00, which is the correct amount, I would have thought that as argos broke the contract by failing to supply the item, so we should have had a refund, and not another egift card, any thoughts on this???????

  • yes, that could be the case, but my point is that argos could not supply, so to me its breach of contract, good job it was not a  £1100 mobile phone or ipad, its a bit like a holiday in covid, voucher or cash refund
  • It is breach of contract, but that doesn't affect the refund situation.  Argos should refund by the method by which they were paid.  If that was via an intermediary, then so be it.  I think you're pursuing the wrong target here.  In order to put you back in the same position you were in before you made the purchase, you would have needed to be chasing the company your husband paid.  Argos refund them, they refund your husband.  Your husband introduced an intermediary which complicated things.

    50/50 odds? Though any odds will be better than the odds of trying to get Argos to issue a cash refund for a payment made via 3rd party gifting code...
