selling house with old married name on deeds etc

    The solicitor has got the title register in the one name, Jane Smith and ID in the name of Jane Brown.  It doesn't match, so they are asking for evidence of the name change.  If your partner has some form of ID in the same name as on the title register then use that, or if there is a document which links the change from Jane Smith to Jane Brown, it needs to be provided to the solicitor.

    it shouldn't make any difference as long as you can prove the link between the name on the property and the existing name.  i sold a house in my maiden name and just had to show my marriage certificate to prove the name change.

    it should be fine as long as she shows the divorce certificate.

    When I recently sold, my house was in my maiden name. The solicitor just asked to see my marriage certificate to verify the name change. There was no hold up because of it.

    She just needs to make sure she signs the transfer deed in her old married name. It doesn't matter. I had to sign it in my maiden name which I'm no longer known by. Solicitor said its not a problem.

    i signed in my married name throughout the sale process.  never had to refer to my maiden name.

    i just checked the papers again as you asked and i have remembered it incorrectly.  the name on the documents are my maiden name but my signature remains the same.

    There’s no specific process for reverting from a married name to a maiden name. In the same way when you marry you don’t have to take and use the name of your spouse 
    Of course you can do a deed poll for example if you want but it’s not necessary to do so. 
    From a registration perspective confirming the reversion from married to maiden name means you produce your marriage certificate and decree absolute and the names match precisely.
    The issue for the solicitor will be which is now your legal name. It reads as if you’ve reverted to using your maiden name and acquired new documents to confirm that. 
    Clearly if you satisfy them and the buyer that you can legally complete/execute in the registered name there’s no issue for us as we would only receive an 3x3cuted deed and forms referring to that registered name. The solicitor would be verifying your identities after all. 
    So this is very much one for you and your solicitor to unravel as to what the legal position is and act accordingly
