Amex Section 75 Claim - How Long?

    I've previously posted in the thread. In my case still no response from Amex or the FOS other than an occfasional we are busy letter/email. S75 claim May and FOS claim in July.

    Tired of waiting. Emailed my MP today as the FOS is a public body paid for by the taxpayer, this performance it is just not good enough. There is no indication from their social media channels or website that they are experiencing delays or backlogs. If they are having severe issues, they need to open up about it and tell us what measures they are putting in place.

    FOS CEO quit in March in part due to the complaints about their backlog - there are a lot of people complaining.
    It's unfortunate that you have a genuine grievance that is taking a long time but that's not the fault of the FOS, it's the fault of all the chancers and frauds sending complaints to the FOS because they were rejected on PPI complaints because they didn't have PPI or think they can get some money off the bank for a packaged account they wanted and now pretend they didn't after their complaint to the bank was rejected, plus all the CMCs clogging it up with false complaints about everything they can throw mud at.

    In summary, nearly 11 months since I lodged my original S75 complaint with Amex and over 6 months since my complaint to FOS about Amex. No update on either! 
    As per tafer2uk's situation, I have travel insurance that will pay out in my circumstance, but seems reasonable to exhaust the S75 route first. 

    So you will either have to keep waiting or make the Insurance co pay out. That is what Insurance is for. S75 is not insurance.

    As a aside you could complain to FOS that the Insurance company are passing the buck by wanting you to claim via your credit card.

    Travel insurance is typically for reimbursement of unrecoverable costs, so if a travel provider (and therefore also the credit provider) is liable to refund a customer because of a breach of contract, then insurance policies will generally require that all such avenues are pursued before a claim on the insurance is accepted.  I'm not aware that FOS would consider that a valid complaint?

    I'm with you on this one @eskbanker. My S75 complaint is around breach of contract (airline/duty of care) so I am pursuing the credit card provider first.
