Debt company has the wrong person for an unpaid Dart Charge

Hi everyone I wonder if anyone can help me please? Not sure if l am posting in the right place, happy to move the post if not..
My son &  his girlfriend have had a bailiff letter from CDER Group for a Dart Charge, however they have the wrong person, they have never owned the car in question or been through the toll, they have phoned the Dart people, the DVLA, & CDER Group, to state that this is not their car, the DVLA have let it slip that the other person has the same name as my son, and they have lodged a query with them, which they said they would send a letter in a few weeks, however the DVLA are dragging their feet over this, & his girlfriend has had them banging on the door shouting & swearing at her, when she tried to shout back to let them know that they had got it wrong she was tdtotake a chill pill.. Nice... This is not only embarrassing for them but they are worried about them taking their car & van away as payment, so are parking them elsewhere.. Do they have a legal right to enter the property or If they do get in & take stuff how do they go about getting it back? Sorry for the long post

    You are asking about bailiffs, and no they have no right to force entry but can follow someone in or come in if the householder opens the door and turns their back to get paperwork, etc.  They can clamp cars but not if they are hired/leased.

    I would stop relying on pointless phone calls (as evidence, they are worth as much as the paper they are written on) and email TODAY to the DVLA complaints email shown in post #5 of the NEWBIES thread and address it for the attention of Robert Toft.  Demand that the DVLA issue the confirmation needed and warn them that the victim of all this bailiff harassment wil be reporting the DVLA to the Information Commissioner for knowingly storing and releasing unreliable and incorrect data against that car and for failing to act quickly to issue a simple letter to confirm the keeper is not you.

    Do report the DVLA to the ICO, it's easy to make a report of a data concern online and I have major concerns about the way the DVLA handle data which they know is incorrect.

    If they keep harassing, tell them you will be seeking compo under DPA and don't let them  off the hook 
    Private Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA :D
