Parking Prices Changed/Invoiced

Hi Everyone,

I did try to find any posts similar to this and I couldn't (apologies if they exist and someone can point me to them - tried searching for 'prices' 'changed' 'etc. - if anyone can direct me to any existing advice I would appreciate it). I suspect I don't have any grounds for appeal/pushing back but I wanted to check.

Issued with a Parking CN/invoice by ParkingEye - I've been using the car park since February 2020 without problem, however I underpaid (paid £3 for 3 hours but it's capped at £2/2 hours or £5 for a full day) on a ticket as they had changed their Sunday tariff at some point in the last couple of weeks and I hadn't noticed (the tariffs are printed on pieces of laminated paper and stuck to signs with the "T&Cs" of parking). It has changed a couple of times in the last 10 months and they have replaced the piece of paper. For this reason I usually always look but I either didn't register the change this time (I'm sure I would have as I was stung with a phoney PCN back in 2011 and I contested it and won, so I'm always very cautious about these things) or they hadn't updated their signage before trying to invoice me for £100. I've been back to look and the new one that's up is already peeling off the sign (not sure what's underneath).

Just wondering whether there's reasonably any grounds for contesting non-permanent signage as I can't provide any evidence of the above (and I'm sure they're not going to be honest about their signs not being up to date!). I had a look at the BPA 'Code of Practice' but can't seem to find anything that would apply to a temporary sign (other than there being some fluff about introducing changes to allow regulars to note the changes)

Thanks for any advice

The BPA CoP definitely has a clause about signage additions when new rules are in force , meaning they should put up temporary signs so the changes are obvious and well advertised

Read it again , because that BPA CoP and the CRA 2015 apply

Have you complained to your MP?.  Sometimes this can lead to a cancellation.
