RESOLVED SUCCESS! PCN Horizon Parking



I received a PCN through the post this morning from Horizon Parking.
On 26th Nov I had booked a parking space via YourParkingSpace at a premier inn for the times of 13:30 - 16:30pm.
The PCN states I arrived at 13:07 and exited at 15:26.
The PCN was issued for "Failure to pay or register your vehicle for the duration of stay". Asking for an £85.00 payment.
Looking through the sticky thread, and this being my first notice received, am I right in thinking this in the next action to take?

Postal PCN from a BPA or IPC member? (i.e. with no mention of any windscreen ticket):
A postal PCN or NTK might be headed up 'Reminder' or 'Charge Notice' or it may even be a letter from a debt collector - it is your Notice to Keeper, in effect, if it's the first letter to arrive. No need to wait, appeal online as registered keeper (or as ''hirer/lessee'' if that's the case, see * below re lease/hire cars).

Also complain to the landowner and your MP.You never know how far you can go until you go too far.2

Yes, send the template and you can add a line stating that you can see that the Notice to Keeper is non-POFA and so the keeper can't be held liable, so that may as well cancel now and save time and money!
We know Horizon ones are non-POFA, e.g. they don't have the words needed from 9(2)f of the POFA and can only hold a driver liable. Their choice!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.
If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.
I note that this Notice to Keeper is non-POFA, and as a result the keeper cannot be held liable.
There is space on the appeals page at Hoirzon's website to add images/supporting evidence.
Is it worth adding a screenshot of the parking I had paid for on that day, albeit that doesn't cover the entirety of the time I was there?

You are not admitting to being there , they do not know who was driving at the moment so why throw away your best point ? POFA . They know the vehicle was there , nothing more
The PCN gives the time that the vehicle entered and exited , not the person , they monitor vehicle movements
This is about a keeper not being liable under the law , nothing to do with the circumstances on the day !!
