Travelup.com to compensate me the cost of Wasted PCR test

a long story short, on 06 November 2020 I have booked a return ticket for my father in law to fly to Kuwait for 06 December 2020 (yesterday). 

Would this not take out the option of S75?

If you read the opening post it is not about a refund for the flight...BA will refund that (to Travelup)
They are asking whether they can get their covid test refunded as they never checked their booking until they tried to check in so did not realise the flight had been cancelled 3 weeks prior.
BA would have informed Travelup of the cancellation, Travelup t&cs requires passenger to check their booking at least 72 hours before departure for any changes...OP didn't so had an unnecessary test.
The covid test was booked and taken so no S75 relevant.

No, there is no breach of contract so S75 is not applicable.
