I think the OP is noting that BW Legal denied ever receiving the OP's letter ... yet another legal company (CST Law) passed a copy of that very same letter (to BW Legal) back to the OP under a SAR. If BW Legal never received it ( 🙄 ) how did CST Law get a copy of it to pass back? ;)

This sounds like lying to the court to me.

Important if that letter was relevant to the case, yes.

I'm not sure it is, I thought it might be another point of attack.

I'd be grateful if you or someone with knowledge of how to write these things would cast a critical eye over the first draft of my WS to see if it's close enough to what's needed.

Is "genuine pre-estimate of loss" still a thing?

    11. 22nd December 2020 a notice arrives that states, as I have requested, the proceedings have transferred to Oxford County Court
    Missing letter: -
    12. On the 7th January 2021 a letter arrives from B.W Legal referencing an amount that has now shrunk back to £154, saying. “We can confirm this matter is now closed with ourselves.”

  • Dated the 7th, this arrived today.
I knew they had until today to make payment of the court fee.
I'll treat this as an early Xmas present, but should I trust it & take it at face value or be wary & somehow check?

Many thanks for the help I've received here.
After 6 years I'm somewhat glad it's over & these b*stards didn't receive a penny from me. In fact I believe they may be out of pocket as it stands!  :)

    Congrats! :)

Perhaps call the court one day next week to get confirmation that they received the notice. (Whilst rare it has been known for a C to inform the D of discontinuance, but they actually continue and end up with a default judgment. Although that tends to be after they've paid the hearing fee - I think the D gets a notification of the hearing going ahead if they pay the fee).
