Thank you all for comments, the reason i am looking for advice and guidance is, if i have to pay both agents, it works out to approx £7,500 out of my sale figure, which is a big whack of money.
I may have to go to the fair trading or ombudsman route,
Maybe agent failed in his duty, as when i dropped the price by £10,00 he should have mail shot all previous viewers giving them the chance to re-view my property!

I would instruct your solicitor to not pay either EA fee until they sort out themselves which is to get the fee.
Common sense says you only pay once. Let them sort it out they are acting like spoilt school children. If they both operate in the same area they must have had dealings before. Once they realise they can't have their cake and eat it, they will do a deal.
In the meantime you instruct your solicitor to retain enough to pay the one (higher) fee, so you can show a court that you had the money to pay.
