B W Legal - help to fight fine

I've recently paid £60 to BW Legal as an amount that I feel is more than fair to pay for parking in mother and child parking space at 7pm for 9 minutes in August. The total cost they're seeking is £160. I didnt get the first 2 letters as they went to my old address and I hadn't updated my V5 form. I web chatted with one of BW legals representatives today to say that I'm willing to pay £60 but that was all. Of course they said that they would still pursue me for the outstanding £100 and I said so be it, I'm not paying anymore. But I'm concerned that I may get a CCJ if I dont pay the full amount. Has anyone else in my position fought them successfully? Any advice would be greatly received. Thank you.

Loads of people fight them successfully.
By paying any amount you have shown yourself to be 'worthy of pursuit'. They will now aggressively pursue you for all the money they allege you owe.
I bet you told BWL you were driving too.

B w legal are not the claimant , the parking company is , plus paying £60 is a part admission , paying nothing would have been better and arguing it in court
In court , a judge will decide if you owe anything , as a judgment
Fail to pay the judgment within a month will mean a CCJ on your credit record for 6 years
So if you lost in Court , pay up , in full , promptly

Hopefully they will return it so you can read the forum and learn what you should be doing. Of course they can't claim £160, this is covered literally all over this forum.Has anyone else in my position fought them successfully? That is the wrong way round, on a forum. It's like opening a book and not reading it, but instead, writing on it.

This is an interesting one. Firstly to allay your concern about a CCJ, NOT ON OUR WATCH, which means stick with us with the good advice. Those you see on here who got CCJ's because they either knew nothing about it or they ignored a court claim, did not respond or go to court and it was issued by default.TillyRuss said:

So, unbeknown by you, the £60 is actually a fake add-on which BWL are not entitled to and 9 out of 10 judges deduct it any way. The claim is tainted, they keep doing it to themselves ?
What is amazing is that they accepted your card for £60
They cannot say it was a payment plan as you told them the amount was all you were going to pay and such you offered a full and final payment.... which they accepted
They then threatened you with further action.
Of course if they follow through, their only claim can be for £40, the balance of the £100
Now, I take seriously the comments from our regulars on here so for the moment, I would like to wait to see what others say.
In the meantime, nothing will happen until after xmas and beyond due to covid and their will NOT be a CCJ

It is not a fine. It only needed to have been be paid if they had taken you to court, won, and a judge ordered it. Now they will target you a a soft touch. As £60 of the money they are seeking is almost certainly unlawful, (an abuse of process), let them take you to court, but before they do, read as much as you can about contract law and private parking companies. nowledge is king in these matters.You never know how far you can go until you go too far.1
