Possibly - if their conveyor belt software is programmed with each and every nuance of the Limitation Act 1980, including that of Statute Barring. 😊

If not, don't fall asleep through complacency.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • In terms of not falling asleep, should I ask them to cease and desist on the 11th?

    Seems like a plan.

Because that's what robo-claim 'legal' firms, do for this despicable industry.

Have you actually done this yet, in these words?

"I deny any debt. I am seeking debt advice and therefore, pursuant to Para 4.2 of the pre-action protocol for debt claims, I require you to suspend the action for 30 days."

  • Yes I have sent that note. Then during the 30 day period I sent another note refering to more information that I needed under the pre action protocol. Finally I reminded them that they cannot start proceedings untill 30 days after I receive all requested documents pointing them again to the pre action protocol. The 30 day lapse has expired on 30th Dec and I haven't heard from them since 1st Dec.

OK but they haven't come back with the information requested under the PAP?  That's good.  Sit on your hands and wait for that to come back and then you can reply ''too late - time's up!''.
