Can I make a Section 75 claim for missing postal return via Hermes?

  • If it was a Hermes return paid for by Debenhams then just leave it with Debenhams to complain to Hermes after you show whatever proof you had of handing it to the shop
    I think that Debenhams are a little bit too busy to bother with this!
    How else is the OP going to get a refund from the remains of the firm or the administrators without getting the case in quick?

    Debenhams are continuing to trade for the time being.  Talk to them.  If they go bump and don't resolve it, then go to the credit card for a chargeback.
  • I am in a similar situation. I collected a Debenham delivery from my local Hermes collection shop and returned it using Debenham return slip on 9/11/20. Hermes tracking shows "Your parcel is on its way back to the retailer. Please contact your retailer for any further confirmation", but does not show that they have delivered it. I think this is a "feature" of Hermes tracking as a parcel returned to another retailer is still showing the same message, but I have had a refund on my credit card.
    I raised a query with Debenhams on Sunday and they have responded saying they haves contacted Hermes to find out what went wrong.
    Debenham website states as follows regarding refunds:

    Returns via a courier service

    Once we have received your return at our warehouse (which can take up to 10 working days) we will process your refund within 24 hours.

    In view of today's development, I don't know if this will be resolved!


  • Found this after my post:
    barclaycard     beginners-guide-chargebacks  (Can't post the address due to forum rules)
    It's a guide for retailers, but explains that Barclaycard will perform a chargeback if a client requests it, and the retailer then has to challenge it to get the payment back.
    I'll try this tomorrow to avoid problems with Debenhams.





  • I contacted Barclaycard using the Help/messaging section on their credit card site.
    They sent me a link to start the chargeback claim, which then emailed me another link where I could detail the problem and submit supporting documents (emails with Debenhams/Scan of Hermes return slip etc).
    Barclays have refunded the payment today.

    Do you mean you did a chargeback to Debenhams or Hermes for the price of the return?
    That doesn't mean you get to keep the money, whoever you did it on can challenge the chargeback and get the cash back from your card if they show that, for example, you did order the product and didn't return it

    That doesn't mean you get to keep the money, whoever you did it on can challenge the chargeback and get the cash back from your card if they show that, for example, you did order the product and didn't return it
    The chargeback will be against Debenhams as that is who was paid for the goods. The return via Hermes was a prepaid label via the Debenhams.

    Op is now in that waiting period to see if contested. While it is 45 days, I would allow a lot longer to make sure.

  • Yes I reckon that's right, confusing a second user has hijacked this thread.
    Debenhams will probably dispute the chargeback if the goods are not returned to them
