    Hi all, just want to update. I won and the case was dismissed! Didn't get my costs though, but I didn't really expect to. Haha.

    Excellent result, very well done. 

    Once you're settled, a short court report with court location, Judge's name, court claim number, did the PPC field an advocate, what did they have to say, what did you say, what did the Judge say, on what point(s) did the Judge make his/her decision ...... would be very helpful. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    It was all over in 15 mins. Claimant had no representation (presumably knew they were going to lose?) And judge had read all WS including their supplementary one. He asked me to just briefly explain what happened which as I did, in doing so I had answered the questions he was going to ask which were about what happened to the first claim (struck out as they didn't pay the fee) and the timeline of communications between the Claimant and I and the Housing Association and my landlord. He said he based the decision on the error of the Claimant to provide the correct information and that my tenancy agreement was proof of residency and by rejecting it they had made it impossible for me to fulfil the contract thus it was invalid and claim dismissed.

    Yay! Brilliant news!

    Now, please promise us you will do the Government Consultation on the level of parking charges and tell them that they are wrong to think residents should have to display paper permits at their own homes where they can be exempted easily by white list as soon as they move in.

    And that the Government’s thinking in making parking charges £100 instead of £50 in residential car parks is ill-advised, and wrongly based on the fear that the industry stirs up when the pretend that their aim is to deter trespassers. We all know that’s the last thing they want at residential car parks and that they target residents. 

    Any evidence you have (photos, statements from neighbours) to show that these thug firms actively target residents not trespassers will be exactly what the MHCLG need to see.

    Have you complained to the managment company again?
     You should tell them that they are responsible for this, and you expect the management company to pay for your full costs including time spent on this and that they can stick their permit up their !!!!!!.
     and should you receive nay further parking charge notices you will look at taking action agsint them as a result of their agents actions under GDPR for miss use of data
