PS5 from eBay... two bricks in the box!!!

Okay... so.

Despite me advising him STRONGLY against it... a family member made the stupid decision to buy a PS5 from eBay (young, impatient, STUPID). This was way back when the pre-orders were being sold prior to launch so he didn't actually pay too much over the odds for it... £600.

But regardless of that, it arrived earlier this week and it turned out there were two bricks in the box wrapped in bubble wrap.

He sent me a pic of the boxes and contents. It looked like the packaging box had been opened and re-taped. He also 'thinks' the seal on the actual PS5 box was broken but can't be certain.

He contacted the seller who told him to take it up with Hermes who delivered it. He told the seller that it's up to them to do that. The seller then asked for the whole package, including the bricks, to be returned, at my cousins expense before a refund could be considered. Again, my cousin refused to do this and the seller has gone quiet.

Obviously he needs to raise this with eBay under buyer protection. But before he does this does anyone have any tips on how he should approach this?

Obviously he has photos of all the tampered with packaging but doesn't want the seller to use some technicality to get around this.

    That aside and not making any comment on anything other than the route of a case.....

    The buyer needs to open a SNAD case, ideally with evidence the item is SNAD.  Then if the seller does not supply a label the case can be escalated on the date given by ebay and the buyer can ask ebay to step in.

    Usually what happens in a SNAD that is escalated, is that the buyer is sent a prepaid label or a refund without return.

    SNAD = significantly not as described 


    Just open a dispute and ask he seller to pay for return postage, then send back exactly what was received.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    Never worth contacting the seller, just open a case in eBay, with evidence and let eBay decide.

    Photos aren't evidence, anyone can open a box and put bricks in the take a photo so that's not going to help.

    How did he pay? If it was Paypal then a SNAD claim should work, if it was bank transfer then you are very ublikely to get any money back, as its your word against theirs.

    He paid with PayPal.

    He's put the claim in so we'll see I guess.

    Yes... anybody can take a picture of a box with bricks that weren't actually in the box. But how else do you provide evidence? 

    This is why I told him not to buy one from eBay. Sellers can be corrupt. Buyers can be corrupt. Delivery companies can be corrupt... especially with PS5's. It seems this was stolen between dispatch from the seller and delivery to the buyer. The seller has good feedback.

    It's the wild west...

  • To be fair I don’t think there is a way of actually providing evidence. As already mentioned anyone can open a package they receive and whack a few bricks in and say that’s what was received. Obviously because this has happened it’s hard to prove either way. 

    This is why I’ve shyed away from high end purchases through eBay anymore.

    Amazon isn't any better. They sent me £500 coffee maker via Hermes. Got instantly lost in transit. 10 days and 1 phone call later, despite me insisting to use something less laughable, they sent it via Hermes again, this time delivered OK. They are £500 out of pocket, not my problem 🤷‍♂️
