Asda online Delivery - Damaged and Out of Date Goods

I had an Asda online delivery delivered today. There were two problems with the order, a pack of bacon was 5 days out of date and an expensive frying pan that I ordered was badly damaged and was oval in shape.  The driver told me if there are any problems with the order to contact Asda for a refund. I made a request for a refund on my online account for these two items to be refunded. I received a reply from Asda that my request for a refund had been rejected, no reason given except the following message: "We’re sorry to hear you were not happy with everything you received. However, we could not approve your refund. We’ll use the information you passed us to make sure we improve. Thanks, Asda" 
 Surely they cannot reject refund requests for damaged and out of date goods?

    No, they can’t, take photos and get them on social media, if that doesn’t work try a chargeback for the items.

    Asda sucks, Tesco tell you if any food is near a best before date and will takeback anything (& refund you) you don’t want (even if you ordered something by mistake).

    They did muck up on holiday delivery slots telling me that the slots would be available in a couple of weeks, only to check a few days later to find the date I wanted was already available but fully booked.

    Tesco don't always pick up short dated items, I've learned to check the order then email CS with photos. Never any quibble about giving a refund.
    Last email contained 5 items 1-3 days short dated.

    Nobodies perfect, but they do sort it out (I just phone CS and it gets sorted), not pull the kind of crap that Asda is doing to the OP and others that post here.

    There would have been no question re out off date stock,
    but a highish value item like the frying pan ???

    Thanks for the replies. Does online grocery shopping come under the same category of "online shopping" with the right to exercise your right of the distance selling regulations if required?

    Yes, though there are some exceptions for perishable items. Something out of date when delivered though is not of satisfactory quality. Indeed it's illegal to sell food that's past a Use By date. Report the bacon to your council's environmental health or trading standards department.
