Does an eBay item have manufacturers warranty

I’m looking at buying an item of eBay the description states: ‘ New: A brand-new, unused, unopened and undamaged item in original retail packaging (where packaging is applicable). If the item comes direct from a manufacturer, it may be delivered in non-retail packaging, such as a plain or unprinted box or plastic bag. See the seller's listing for full details.’

I’m confused as to whether or not the product (iPhone) carries the original manufacturers warranty,   I’d appreciate your advice

    You know immediately from that its going to be a knock off phone no?

    Assuming the vendor is in the UK your statutory rights are going to be stronger than the 12 month manufacturer’s warranty. Assuming it is a fake then there will be no warranty anyway.

    If it is important to you then ask the vendor and keep a copy of their response to if it turns out to be false you can evidence their misselling.

    If you're looking to buy an iPhone, and want a warranty then I'd avoid ebay.

    You can (and I would) email the seller (always through eBay) and ask. That's the best way to know. Even if you do buy anything 'dodgy' from eBay they have that guarantee that you can have a full refund. But always communicate with sellers (and buyers) via eBay so there's a record of what's going on. 

    If any item isn't direct from the manufacturer, you have no idea how long there is left to run on any warranty, so it's probably always sensible to check with the seller before you commit. If the seller doesn't respond, then you'll know it's dodgy and won't buy anyway.

    Probably not, no.  Apple's own warranty page says "for a period of ONE (1) YEAR from the date of original retail purchase by the end-user purchaser"

    If someone is selling their own device, the warranty rights lie with them. If it's a reseller it's probably not going to be considered a "retail purchase" and that's even if it's new.  If it's not there's a good chance there is little or no time left on the warranty anyway.

    Emmia is right. If you want a warranty, avoid eBay.

    As I understand it, Apple do not OEM their products.   So, that bit won't apply to them.  And if you did get an apple product in OEM packaging (brown box) then its likely to be knock off.
    Some retailers do use ebay as an extra distribution method.  If is one that has a retail outlet then you can feel safer about them.   If not, then you move closer to the possibility that its knock off (fallen out of the back of a lorry - or the recent large theft that made the news) or not a genuine item.

    Could be a grey import? I have a friend who buys his yearly iPhone upgrade from Hong Kong and reckons to save money even with customs. OTOH he's never had one go wrong to know if the warranty would work. Maybe he'd be asked to take the phone back to HK? :D

    Apple refurbs come in that sort of packaging, albeit white rather than brown.

    The apple store in the UK wouldn't deal with him - a year or so ago I was in the regent st branch, and an assistant was politely and patiently explaning to someone who had done this that he wasn't entitled to the repair he was seeking.

    But its listed as band new, unused and so couldnt be a refurb
