Seller refusing to accept return

Hello clever people,

just checking if there is anything else I can do to get a refund. Dear Rose Skin Co,

THE CONSUMER CONTRACTS (INFORMATION, CANCELLING AND ADDITIONAL CHARGES) REGULATIONS 2013.

On the 8/11/20 I ordered an IPL device from a company called RoseSkin. I wasn’t sure how I’d feel about a home IPL but was reassured that they offered a 90 day return policy .
So on the 14/11/20 I received the goods and immediately emailed them my concern that the light flashing was “blinding”. After several conversations about whether it was me, the device, had I tried using it wearing glasses (yes), I decided to cut my losses and on the 19/11/20 I requested a return address for a refund. Since then they have refused, stating that their policy is goods must be returned no later than 90 days and no earlier than 70. They said this is so people will give their products a decent try.
ive explained that I don’t need to wait 70 days as under distance selling regs I have a 14 day cooking off period. They are now ignoring me. 
Do the regulations apply to overseas companies? (The are in Canada). Is there anything else I can do? Many thanks,

  • UK legislation does not apply for non-UK sellers ... unless their T&Cs confirm that they abide by the laws of the countries into which they are selling. Consumer legislation in the seller's country applies - in this case Canadian legislation. OR you abide by the terms of their policy. (Check the terms online to confirm that what they're saying is in fact what their terms say).

    is very clear about where they are based and what laws govern the contract of sale:

    SECTION 18 - GOVERNING LAW

    These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Canada.

    and they also have their 70/90 day returns policy shown 

    1. Trial your product for at least 70 Days from date of delivery, but for no more than 90 days.

    2. If you are not completely satisfied by the performance of your RoseSkinCo product, email a customer care representative at info@roseskinco.com

    3. Once approved, return the product (in its original packaging) via a trackable mail service 100 days from date of purchase to the address provided by our customer care representative

    Depending on the cost of a trackable service to Canada and the original price paid,  the OP might be better off seeing about selling the item here rather than shipping it back as the return postage cost isn't refunded.

  • The returns wording (if taken literally) is difficult to comply with ... how do you ensure that the product arrives back exactly 100 days from date of purchase? ;):D
