Hi all,  I don’t know if this is the right forum for this topic but here goes.
Back when I was on furlough I was still accruing holiday and when it got to July, after hearing nothing from my employer, I emailed HR and they informed me they used 2 weeks of my holiday whilst on furlough and an email had been sent out to inform everyone of this. Now I 100% did not receive this email so I was a little annoyed to find out my holiday had been used without any notice. I then returned to work and they made me redundant last month (I have since found a new job and everything is all good), but as my gardening leave is coming to a close I’m still feeling aggrieved that my holiday was used without notice.
My question is, am I entitled to anything like to claim the money back as they didn’t follow the correct protocol?

Were you paid for that period at the time?
  • Yes I was paid the top up 20%
  • Do you think I have no case then?

Did you not query the extra pay at the time?
  • Because It was only £50 extra a month I thought it was the Easter and may bank holiday payments
  • But surely the point is that whilst I didn’t need to agree to using my Holiday, they had to give me notice and I did not receive notice for this

You are saying you did not get the email but were happy to accept extra payments without checking what they were for.

When were the payments made,  have you checked you got extra for the 2 weeks and the BH

    What are you paid.

if you assumed they were the BH if  £50 was paid in April and May for the BH that's £25 extra for each day for the  20% top up making your pay £125 a day ~£32.5k
for a week off at that rate you would be looking at £125 extra

What did you do about it after you questioned it in July, you may fall into the too late 3 months time limit..

Even if you had got them to agree they would have had plenty of time to have you take the holiday between then and now
how much longer were you on furlough and how much garden leave did you have.
