Credit Score after DAS arrangement scheme

Hi,
could someone please advise me -
In 2013 I setup DAS arrangement scheme with several creditors this was completed in 2015. All creditors reported default date & dropped off my credit report in 2019 except Bank of Scotland. I had a current account & outstanding overdraft, they agreed my repayments each month however did not add a default date. My report shows 6 months in arrears with 1 credit reference agency, missed payments each month with the other & the last one shows Debt Management plan until this was settled in 2015. This information will be reported until May 2021. I contacted Bank of Scotland and advised under ICO guidance the default date should have been added in 2013. They have refused to add the date as I entered into DAS arrangement scheme & setup repayment arrangement. Is there anyway I could appeal this? Any help would be be appreciated. Many Thanks Danielle

I'd argue that the rules with an overdraft are much less clear than something like a loan or credit card. The latter have clear obligations to follow (a monthly repayment for a loan, minimum repayments for a credit card) that you can clearly fail to abide by and therefore default. An overdraft doesn't have that, and many people who are asked to repay their overdraft do not have the means to do so in full and will do it over a period of months or years. You've not really "defaulted" because the overdraft itself doesn't have any repayment terms per-se so there's nothing to default. If they allow you to repay over two years then that's just an AP, not a default.0

That depends what you mean by default, most people use the term "default" to mean missed a payment, but that is not the legal definition which covers any breach of contract such as being asked to repay an overdraft as per the contract and failing to do so.1

Thank you for your response.This does make sense, my issue is my mortgage application was refused as my report showed Debt Management Plan. I am now financially stable & passed affordability checks however since Covid-19 mortgage leading criteria has changed & was advised my application was automatically refused. Is there anything else I could do? Many Thanks Danielle1
