Section 75 claim approved! Further questions....

Hello all,

I have just had a section 75 claim approved by PayPal Credit for a cellular Apple watch device that was subsequently found to be blacklisted after receiving goods. This means the cellular function was blocked by a network operator rendering it useless.

They have actually refunded me £1 more than the purchase price for some strange reason. It was described as a ‘goodwill gesture’

One question I have is there is no request for me to return the goods. Am I legally obliged to return the goods or should I keep them? Also, is that money100% mine to keep? For example, could the seller appeal my section 75 claim and they subsequently take the money back?

  • If it's section 75 then the seller has no recourse as they haven't refunded you.  There is no money for them to take back.

    The watch belongs to PayPal if you wish to ask for it, but it's unlikely they'll want a broken watch for the office.
  • If it's a section 75 claim then the money had been paid by the card provider so no come back from the supplier, no reason why the card company couldn't then try and get money back from retailer but we understand this is rare. In theory the card company own the thing that you bought and may want it back but unless they request it then hold onto it. If it was a chargeback then the money would be claimed back from the seller and they could pursue you for payment by other means.
  • I would get in writing from Paypal what they want you to do with the watch, if you can't get that, don't try and sell it or use it
