Limited capability for work benefit - Backdated payments.

Good morning to you all, I am in my late 40's and now fully retired due to my diagnosed conditions and other underlying issues which affect me in quite a bad way, My wife has had to do all the paperwork as its simply overwhelming for me, Several months ago she applied on my behalf for the " Limited capability for work benefit" and it took Universal Credit several months to make the decision and I was awarded it, So my wife looked into the last few months or since she started the claim for the benefit at the money owned since it began and UC (Universal Credit) have told us that I am NOT entitled to any backpayment as they only start it from the day its awarded? If this is so how come every other benefit is awarded from the day you apply or thats how I remember it been that way?

Does anyone know anything about this please or can offer any advice as this is rather strange of the government to do this and UC are not going into details but just telling us that I am not entitled to any backpayments?

    If you were awarded limited capability for work related activity (LCWRA) there's a full 3 month assessment period waiting time and then it's paid from the 4th month of your claim, starting from when you provided evidence of the health condition, so it depends on the dates of AP and when you provided the evidence.
    If the decision was just limited capability for work (LCW) then you won't receive any backdated money and no extra money each month.

    There are a number of things that would affect the timing. If you have been on UC for some time and had already been found to have LCW but your wife reported a change in your health so this would have been a reassessment then that would be different to the situation if this was the first time you reported a health condition.

    Regarding your last point he LCWRA element of UC (just like the Support group component of ESA) has, in most instances, an associated waiting period when new claims are made.

  • The key here is when exactly your health condition was declared for UC and fit notes sent in to start off the WCA, and whether they were continuous.

    The fact you were already getting PIP is not relevant. The health condition has to be reported to UC. The consideration of health issues is different for PIP and UC.

    In that case it does, as others have said, depend on when you reported your health condition supported by a Fit Note.

    If you reported your health condition at the same time as you claimed UC then the LCWRA element should be included from the fourth UC payment.

    If you started the claim and only reported the health condition later then you get the extra (in most cases) in the fifth payment after you report it.
