TV EXTENED GUARANTEE

Options
Hi didnt know where to post, i brought a tv from richer sounds about 1 year and a half ago.
basically earlier in the year my tv had a picture fault .under samsung warranty they replaced the panel.tv had same issue again not long after.  after the 2nd time it happened before samsung repaired it. i was told by richer sounds if the fault happens for the 3rd time they will offer exchange or refund under the 6 year guarantee. samsung repaired it  under samsung warranty for the 2nd time.
NOW the tv has had a screen problem ,(obviously now  the samsung warranty has passed)for the 3rd time and richer sounds say they want to repair it.i am arguing saying they told me that they dont repair it the 3rd time and i want a refund (credit)or exchange as i do not want the problem to happen for the 4th. am i within my rights to get a refund  or exchange as they told me earlier in the year after they told me themselves they don't repair for the 3rd time?

Did you do the repairs via Samsung under Richer Sounds instruction or off your own thinking?

Under your statutory rights the retailer has one chance to fix the item, if it breaks again you have the right to demand the final resolution which is a refund (note that the law entitles the retailer to deduce the refund to reflect the use received to date).

So, if you went via Samsung by RS instruction then you are entitled to demand a (partial) refund from them. If you went via Samsung off your own accord then RS are allowed one attempt to fix it first.

The terms of any warranty are separate to your statutory rights and they can say whatever they want it to but you can always pursue your statutory rights if they are better than the warranty.

Samsung warranty  subject to any terms and conditions , no rights to a refund
Richer Sounds warranty again subject to the terms written in the warranty received at purchase .Refund again dependant on the warranty and this is subject to what it says .
Consumer Rights  the law against the vendor , refund accepted less xx amount for usage. But again retailer can inspect/ repair .

Reading RS warranty for my TV you do need to give them a chance to repair .
