  • Can they do that whilst the claim is being disputed?  If the claimant is successful with the dispute they will get the money back.  
  • Well Hubby has asked for further information etc (can't recall the full details as he wrote the letter). Neither of us claim anything currently but he does have wages. His ex-wife does claim for lots of things and also had the same letter so not sure how that will work out. As far as I am aware, she has said she is "just ignoring" the letter.
  • We have just received a reply stating that as they contacted him first in April 2013 and had no reply, they aren't changing their mind. He has no recollection of this letter as he is military and was likely moved on. Any further advice from anyone please?

    I'm not sure what other advice you would like. Overpayments do need to be repaid back. HMRC won't just wipe the debt off. You can arrange a payment plan to pay the debt back.

    If the debt arises from a joint Tax Credit claim although both claimants can be held liable for the whole debt HMRC will usually seek only half the debt from each party.
