Hello everyone,
I hope you are all keeping safe and well.

As the title states, I received two letters from SCS Law, one with a single claim of £145 and the other contains five claims of £145 each. These charges include an additional £60 fee each for some unknown reason so all six claims total £870!

I am in total shock at receiving a claim for PCNs dating back over three years!  I'm finding it difficult to concentrate as I lost my job in April and have not been able to find any new work and do not have the money to pay this claim. I really am in need of some guidance, please.

My situation has been made worse in that the PCNs, including the two SCS Law letters, were sent to a relative's address an hour away and I could not always collect the PCNs on time and would miss the appeal deadline followed by the usual debt collection letters which I would ignore until they stopped.

I have read through the 'NEWBIES' guide several times and followed many links and fallen down a rabbit hole as some links seem to be slightly contradictive and I am now going around in circles double-checking and losing my place to the point my head is aching and my eyesight is blurred.

The SCS Law letters include the sentence, "Please note that this letter is to be considered a letter before claim for the purpose of the Pre-Action Protocol for Debt Claims" and are both dated the 10th November so should I wait and see what they send me next I'm worried as I only have three days to Acknowledge Service of the claim.

My questions are:
How do I
Acknowledge Service of the claim on the MCOL site without a claims number and defence pack password?  Where and when do I obtain a number and password?
Do I send a SAR to the PPC, then email SCS Law first? Or have I completely misunderstood the process?
Finally, what do I use as a defence as I threw out all but one of the PCNs and some date back to 2017 and 2018 and I cannot remember any of the notice details at all.

Any advice would be most appreciated.

P.S. Morrison's closed down and the car park now sits under an empty building so cannot contact them for assistance.
I have merged the two SCS Law cover letters together along with the blurb from one letter as it is identical and attached.

Warmest Regards

Have you actually received a claim form (N1) from Northampton CCBC?  Until you do, you cannot submit the AoS.  Why are letters for you (presumably the registered keeper) not going to YOUR address, the one that the DVLA has on record?

Where you shopping at Morisons when you became ensnared in the murky world of private parking?

you need to update your V5 logbook asap.

    who is the PPC?

"Do I send a SAR to the PPC"

yes .... and email there DPO with your correct address and instruct them to ESASE the old address

You are at LBC stage so you send a SAR to the PPC, like the NEWBIES THREAD tells you.  This puts you in a more informed position at the time when you later need to defend a claim (that you do not yet have).

My situation has been made worse in that the PCNs, including the two SCS Law letters, were sent to a relative's address an hour away.
When sending the SAR you MUST also require the PPC and SCS Law to erase your wrong address from their database and change it to your new address, so that subsequent letters and any claim doesn't get missed.  VERY URGENT TO DO THAT, TO STOP YOURSELF MISSING THE CLAIM.

What you MUST understand is that SCSLaw is a very different set up to your own solicitor.
Your own solicitor will be a professional and duly advise you correctly.
SADLY in the parking scam industry there are legals who decide they are not professionals and send caution to the wind keeping their fingers crossed that you are a mug and hoping the judge is a mug.  Of course they are totally misled by themselves and that is why firms like SCSLaw fail in court.

They are called Robo claimers and issue claims because a parking company says you owe £100
Does the legal know what's it's all about ..... seems not hence they are rubbished in court.

Why were there so many parking charges racked up at that one site?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Hello Le_Kirk,
No, I have not received a claim form (N1). This is all new to me and have no idea what forms I should expect or when to complete them.

I have no idea why the PCNs and recent letter were sent to my relatives. I briefly lived with them over ten years ago for a few months whilst my own home was being refurbished but did not register living there as it was a short temporary stay.

    Thank you for your reply

Luckily, when you read it properly, you'll find the NEWBIES thread post #2 has a section 'IMPORTANT - KNOW WHAT HAPPENS WHEN' and it also explains about how to contact a PPC for a SAR (also asking the DPO to erase an old address).

Any acronyms you need explaining are in post #5 of the sticky. This saves us repeating ourselves, like Groundhog Day on here.

Yes, I used to do a regular monthly shop at Morrison's and usually managed to leave just under the two-hour limit but it was always close. Just trying to find a place to park could take up to 20 minutes on occasion as it was so busy.

My logbook has my correct address on it.

The PPC is Euro Car Parks Ltd

    Thank you so very much.

    Hello Umkomaas,

I am a stroke survivor which has left me a little slow in thought as well as physically but I always did my best to get my shopping done and get out on time.  I cannot remember the specific details but it was always a busy supermarket and on many of the occasions I shopped there I would only just get out before the two-hour limit, sometimes over it. I noticed that by the time I opened the PCN several weeks later the date on the PCN would be four or five days old, effectively giving me only twenty three or twenty four days to reply. If I could not visit for a few weeks I would have no time to appeal at all. Also, it was not obvious the letters were PCNs so my relatives would not always tell me immediately (they are elderly).

Looking back I now see I should have just boycotted the supermarket altogether. Shopping for groceries should not be that stressful.

    Many thanks for your reply
