Hi
So my workplace parking company have invoiced me a fine contravention 80, saying i didn't display my permit.
I have sent them my permit, pictures of signs with different wording and they are still harassing me.
I should of ignored them but i am now at IAS appeal stage.
I have been in contact with the landowners and myworkplace and now have two emails from the manager of the site saying that he has told the parking company to cancel the PCN and to also review the signage on the site.
The parking company however are not doing it for whatever reason, so i have a quick question
Do i just stop the IAS appeal and ignore it or do i carry on throwing evidence of the pcn being cancelled at them ( i have been arguing with them for a month now on the IAS appeal site )...not really sure what to do next?
Thanks

If you have started IAS then finish (i.e. continue with it).
You shouldn't have bothered but you might just be a rare one who wins if you provide the proof that the landowner requires the PCN to be cancelled. You need to state that this instruction removes any 'legitimate interest' that the operator may have thought they had, to pursue this charge. It then becomes a matter of dispute and an unrecoverable penalty, being that an unsupported PCN has no commercial justification and can be fully distinguished form the Beavis case.PRIVATE 'PCN'? Thankyou.
If they do take me to court would the emails i have from the landowners stating that they have asked for it be cancelled enough for me to win against them?0 -
Maybe - but every decision is down to the facts and the Judge's opinion. Certainly it's compelling evidence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks, I will continue with the pointless IAS appeal and see how far they take it.2

First of all, they can not take you to court ( successfully) if the principal, that is the landowner has withdrawn permission. You have evidence that the landowner has effectively done this ( withdrawn permission) by means of telling them to cancel.Odds on the IAS will refuse any so called appeal, unless you fall into the lucky 20% pile.Have you contacted the parking company with evidence that the landowner has told them to cancel?something along the below but not word for word its just to give an idea.......Dear PPCI am a little perplexed as to why you are continuing to unreasonably pursue this/these parking charge notices, for which i have been informed have been cancelled by the landowner/land holder .For the avoidance of doubt, and as a courtesy i have enclosed documentation stating that the parking charges must be cancelled. At the time, and in good faith i entered an appeal with the so called Independent appeals service (IAS) which after a little research appears to be anything but independent, due to amongst other things direct links between key people, the private members trade association (the IPC) to which you belong, and Gladstones solicitors and as such i find the whole thing shocking as the whole thing seems nothing more than a charade. Therefore this parking charge must now be cancelled with immediate effect, otherwise i may have to consider my position over your unreasonable action(s) .I am also now instructing you to remove and to cease processing my personal data that you have in relation to pursuing the parking charge notices in accordance with GDPR, you may however retain some data to ensure that my vehicle is never issued a parking charge notice on that car park againLots of love, hugs and kisses, steepFrom the Plain Language Commission:

Just seen this, no i haven't contacted them directly yet i have just put screenshots of the cancelled emails from my workplace and the site managers etc saying to cancel it and also evidence that my workplace has never even heard of the whitelist they keep banging on about.
I will see how they finish this IAS appeal thing first then i will use the above
They really do know how to bait you in though and are proper wind up merchants ! I like the way they always wait until the last day of the IAS appeal ticking down then they reply lol.

Do the same. Play them at this game.
Keep replying on the IAS system on the final day open to you, and I would show those emails next, or refer to them and tell the PPC you will counterclaim if they sue you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It is a very bruising experience appealing to the IAS. They may be waiting until the last day to respond because many of the staff are on furlough. Probably someone WFH in their underpants is posting the repliesstepp said:Just seen this, no i haven't contacted them directly yet i have just put screenshots of the cancelled emails from my workplace and the site managers etc saying to cancel it and also evidence that my workplace has never even heard of the whitelist they keep banging on about.
