Luckily, I work with someone who lives 2 doors up so he knocked for me and collected the parcels. He brought them into work last week (I’ve been at home with my daughter who has been isolating). Now I’m back in work I’ve opened them and one item is missing, a huge beauty box of several items. My colleague said this was a he was given.
I’ve spoken to M&S who said the item was delivered from their side of things.
In the past, when we first moved and stuff was wrongly delivered, we knocked and the new owners denied receiving anything and we let it drop.
I know it’s my own stupid fault but where do I stand legally on this one? It’s all made difficult at the moment in lockdown as I can’t run round there and ask for it myself.
Appreciate any helpful advice on this one - I’ve asked my colleague to knock again for me but I don’t want to cause him hassle and I feel bad asking him again.
Thanks in advance

I wouldn’t ask your colleague to knock again and basically accuse them of stealing something, would you do that for someone, I certainly wouldn’t .
it is also nothing to do with M and S as they sent it to the address they gave you and if they have tracking showing all the parcels were delivered Then that’s the end of it.
if you can prove the new owners of the house stole your parcel , and you can’t , then I suggest you take them to small claims.

To clarify, had the people it was wrongly delivered to opened the box to remove the item or was it still sealed from M&S?
If it was sealed, then the item wasn't sent and you're entitled to it - if it was opened, this is nothing to do with M&S so you have no recourse. They delivered it to where you requested.

I would say you have no cause to complain and no proof that the unintended recipient stole the item, it could have disappeared anywhere along the way. It'll be a lesson to watch the checkout process very carefully in future. As it (they, if more than one parcel) was delivered to where you said you wanted it delivered - and something has gone missing between them taking it in, passing it to your work friend, who has passed it to you, there are too many variables there in terms of where it could have gone missing. It's not one you can blame the courier for, as you didn't receive it when it was delivered. Sadly I think you'll have to take a deep breath and move forwards without the beauty box, and tell whoever it was for not to look in the mirror until you've sourced a replacement
Although an error - don't label yourself as stupid - we've all done something silly at some time in our lives, but we learn from it, and we don't do it again.
