    Hi @Coupon-mad, yes it is past the initial filing date and it's the 2nd witness statement they've now submitted. The hearing is this Friday.

    OK so after sitting down/saying hello, tell the Judge there is a preliminary matter that you would like the court to address:

    a very late extra witness statement from the Claimant which does not comply with the witness statements deadline, unfairly and unprofessionally slags off the Defendant for daring to use online help and you ask that it should be struck out.

    Hi everyone (especially @Coupon-mad)

    My case was struck out! Thank you so much to everyone who contributed advice here. And, in case anyone else is having to deal with BW Legal's bullying tactics here are a few specifics:

    They sent along a barrister (?) who had no knowledge of the case and had to borrow a copy of my witness statement to look through.

    After the judge decided the case should be struck out, they asked for leave to appeal saying this case would set a legal precedent (or something like that) and the judge refused that as well.

    However, I was at a loss as to how to explain to the judge which parts of the Civil Enforcement Limited v Chan case applied to my case and I could have really done with some advice on how to proceed once in court and how to draw the judge's attention to that as opposed to all my other evidence. It was this case that was the deciding factor for me today so I encourage others to use it and know how to refer to it.

    Off to celebrate now, good luck to everyone else on here pursuing cases and refusing to succumb to the bullying tactics used by these firms.
