Speeding ticket likely

Hi, do you think I may get a  ticket?

Last week in the morning, I was on the m6 where there's the smart motorways set to 60. There was a lane closure due to an accident, so the limit changed to 40, though we were crawling. 

When all lanes were clear and opened back up after the 10 minute jam, I put foot down to 60, but just as I realised the last speed gate still had 40 for some reason even though past the traffic by half to 1 mile, but it was too late. I was in the middle lane I think and only a lorry in the left lane. About half a mile after, I saw a flash.

Not sure it caught me or something else?

Are these basically average speed checks? As I would have been doing well under 40 average given I was stuck at 5-10mph just before?

My license is currently clean (had 3 points which came off in 2016 or 2017)

    You'll know for sure in 14 days (if you're the keeper). If you're not the keeper, the police have a 'reasonable' amount of time to issue after being your details from the hire/lease company. But PePiPoo is your best resource for dealing with any charge if it comes - they're no better clairvoyants than we are however.

    Its a waiting game.  Cameras can activate for both average and instantaneous speed.

    If the "speed gate" you refer to was an AMI (the separate signs above each lane) and the 40 was in a red ring, then that is an enforceable aspect so "IF" that signal had cameras on the gantry (most of them don't) you could have been flashed but you would have seen the flash just a second or two after passing under the signal. That camera is instantaneous (not averaged) and is based on the speed limit on the AMI you just passed under. 

    Were there any other signals "half a mile later" when you thought you saw the flash?
    The traditional speed cameras like those on the back of the AMIs also flash 30 seconds after the camera starts up to test the flasher unit, and also periodically when they are operational which makes some people believe they have been caught when in fact they were just at the right place at the wrong time!

    Yes, there was a camera under the gantry I'm sure as the following day I looked and it showed up on my waze gps map.

    But the flash was at least 5 seconds after, not 1-2, and I couldn't see any other thing it could have flashed - the lorry was going slower in the left lane. 

    I suppose I have around 10% built in to my speedo otherwise doing 20mph over would land me in the category B penalty (4-6pts + fine) 

    I guess I'll see in the next week or two. 


  • OK just had a police letter drop through the door, asking me to complete within 28 days. 
    Clocked 61mph (in what I thought was 60) in a 40mph variable speed limit. 

    Not sure how generic the letter is, but saying If I complete on time I could maybe attend an educational course (I'll take that any day), and I don't I'll get points etc. 

    Bit worried as that puts me in band B with points etc. 

    Is my first port of call to return the form ASAP or go to that website others mentioned for advice?..

    Do you think its definitely points? I did a course in speed in 2015 or 2016.
