HORIZON PQRKING @ Tesco

Hi. My Mrs received a ticket stating she'd over stayed in Tesco (Barrow in Furness) but she was in a town 12 miles away getting a tattoo. She has a ticket for the car park she was in but it doesn't state the reg. I've asked the tattoo shop for a receipt/booking confirmation also.
Is there anything else I can do? 
I had one a couple of years back and never paid it and now I have a CCJ.

    I had one a couple of years back and never paid it and now I have a CCJ. 
    That was daft, seeing as these can be beaten on appeal or in court and we do this all the time!  We also help people set aside these CCJs but that's unlikely if you wilfully ignored a court claim.  Anyway, as for the Horizon one:

    Just do what the NEWBIES thread tells you to do.  Horizon don't use the POFA (don't ask, read)!  Obviously THE DRIVER DOES NOT APPEAL TALKING ABOUT WHERE THEY WERE.  This is easy for the registered keeper named on the PCN letter to see off.

    No-one will link the NEWBIES thread for obvious reasons.

    Start by complaining to the store manager and/or the CEO. If the car was elsewhere then point out that their agent/sub-contractor has breached the DPA/GDPR by obtaining the keeper's personal data without reason, and as Tesco are the principle, they are jointly liable. 

    If that doesn't work then appeal using the template in blue text from the first post of the NEWBIES sticky thread.
    Add a one liner that the vehicle was parked elsewhere at the time.

    Get whatever proof you can that the car was elsewhere including statements from witnesses and smart-'phine tracking data if available.

    Also complain to the DVLA about the data breach, and complain to your MP. Include proof the car was elsewhere in all complaints.

    Everything needs to be done by the keeper without identifying the driver.

  • Thanks for the reply. Should I state exact times etc including a ticket attached? Or keep it brief. I'm also waiting on confirmation of the tattoo booking too to use as evidence "the driver" was elsewhere

    None of it matters and you don't need the tattoo booking which could expose who was driving.

    Honestly forget the complaint, just send the NEWBIES thread template appeal in the name of the person on the PCN.  No asking which box to tick...

    Where ever your wife was at the time does not mean the car was there to a PPC, it won't mean a thing they will just quote their scamming terms and conditions like a parrot.
    This is most likely an ANPR (not fit for purpose) misread.

    As above , Horizon monitored the vehicle , not the person , they do not care where your wife was , or why

    It's like on a t v programme where they track the phone and the police infer that the victim , or suspect , was at that location , without actual proof

    Sometimes when I go out my phone stays at home , proving that the item and the person are not intertwined , or I go out without the car , who knew ?

    It may be an anpr misread , it maybe that you were misled , lol ( I won't go into that plotline but have seen it on Crime ID or on  Snapped ) , it may be all kinds of reasons that Poirot could uncover , so be like him , but meanwhile follow the simple advice above and don't overthink this
