My house is a new build house and there is a restrictive covenant in my title deeds in favour of a property management company. I lived in my new house since 2016. I am currently completing the sale of this house but the sticking point in the sale is that the company name mentioned in my title deeds doesn't exist, letters from my solicitor to the registered address bounce back. My solicitor contacted the property management company which took over the first company regarding issuing a certificate of compliance, they denied their responsibility for my house and refuses to sign anything. We contacted the company which set up this company and also my house builder, they were all uncooperative. I tried to complain against my builder and the property management company with no success. I even approached citizen advice, NHBC, customer code, and trading standards regarding my problem, they advised they can't help. My solicitor hinted at removing the restrictive covenant from the deeds since no one claimed responsibility for the house, but this I was told this a lengthy and expensive process.
I have been stuck at this point for about three months now. I feel helpless and with no full control on the house I own and pay its mortgage. Any advice please?
