Shareholding of deceased - small estate indemnity fees

Hi,
My mother wants to have my late fathers shareholding transferred to her by the registrar.
She is not getting probate so they advise to use their small estate declaration and want a £44 admin fee for a countersigned declaration or £85.50 without the countersignature.
She has managed to get her bank to stamp and sign as countersignature so the admin fee will be the lower £44.
However why does a fee have to be paid at all? as he does not feel it is fair considering she has lost her husband.
Is there any way to get around this admin fee completely?

Administration fees are charged to cover overhead costs including indemnifying the registrar. Do you think that somebody else should pay the cost?0
