Furlough and bank holiday entitlement

Hi can anyone help I was furloughed for the 6 and a half weeks at the start of lockdown back in March,through 3 bank holidays and we only got paid the 80% . I've read on the government website that your employer should have approached us at the time about it and either top us up the 20% pay for those bank holidays. As they didn't the options are either give us 3 days holiday or pay us the 3 days ,is that correct does anyone know? I've approached my employer about this and after months of waiting for a response they have come back and said they are going to pay us the 20% top up for those 3 days . Is that acceptable? Thanks

  • Of course that is acceptable, that way it means you get 100% for the three days.
  • Going by how its wrote on the website it sounds like that's ok if that's agreed between you back at the time but if it isn't then should be the latter options.
  • Yes it is acceptable, you have also probably put yourself at the top of the list for redundancy, I very much doubt it was worth it.

    Nothing wrong with looking after yourself and fellow workers, however at the moment a lot of people are thinking about picking which battles are worth fighting, the employer has already offered an extra 20% for three days, are you going to accept that or refuse the extra 20% and insist on the three extra days instead?

    Your employer has kept you on, at considerable cost even whilst using the furlough scheme and you are quibbling about a few days holiday, having just had months of holiday.

    Being seen as a difficult employee, in a time of large scale redundancies, is not sensible.
  • We were only off for 6 weeks at the start being made to then we went straight back and it's been work as normal we haven't been affected really so have been lucky . I understand where your coming from .My partners firm gave all there workers the extra 3 days holiday so that's why I asked our work.

    What they have done is what nearly every employer accepts is correct, and conceivably better than what the law provides (it is a complex question as to whether bank holidays form part of the 20 days protected by EU rules which require pay at 100%, or whether they are part of the 8 extra days covered by UK law where the position is not so clear, unless the contract of employment sets it out).
