Advice needed regarding son dla

Hi my son claims dla lower mate mobility and middle rate care. The claim started when he was 4 and was awarded till he's 12 which is another 4 years away. Can I update his claim to get higher care the mobility would be the same he can walk but his care needs have changed. 

Would I be allowed to update his claim and how.

    To be entitled to the high rate care he must need care/supervision frequently throughout the day and night.
    If he does then you can put in a change of circumstances by ringing DWP, then you'll be sent more forms to fill in and return with all your evidence. They will also look at both parts, not just the care part.
    If he doesn't need care/supervision at night then he won't be entitled to the higher rate.

    When I started claiming he was a good sleeper now I am lucky if he goes to sleep before 3. Then he struggles to get up for school and he has poo under his nails and needs a bath most morning. I think I will ring today.

    I rang and received the claim pack today very quick have to have it but early December so will need to start probably.
    Was told it might go up, down or stop so to make sure I put all the paperwork to prove it in. 
    He is definitely not the same child as he was when I made the original claim and now he has a diagnosis hopefully it will help.

    A diagnosis makes no difference at all because it's not about a diagnosis. If it was then you wouldn't have got the award before the diagnosis.

    True but he's on a wiley clinical report so that proves the condition.

    Remember, it's not the condition itself that gets the award. You need to prove he needs more care and attention than that a child of the same age that doesn't have a disability.

    I know but I think most children with a learning disability are not the same as a child of similar age with none. The paper work arrived yesterday and I have to have it back early December. Need to start I think.

    Yes but this doesn't mean you're automatically entitled to high rate care DLA. You can also ring for an extension to return the form.

    He gets middle rate care and lower rate mobility. He can walk with supervision so don't think that will change but the gerenal care needs have changed regarding night time and sleeping. He needs some one with him all the time now and watching him properly. Today I nipped to argos came home his 18 year old sister was watching him for me and when I got back he had got my craft iron out of my draws plugged it in and burnt the carpet in 2 places. This is while my daughter is supposed to be watching him just lucky he didn't burn himself. And she will not be looking after him again.

    Pleas dont be angry with your daughter too much.
    Accidents happen, .
    Did she know your craf irons were there, probably not. But you did.
    He could just as easily have done it under your care. You cant watch him every second.  Lock the drawer, put stuff like that at a height.
    She will feel badly enough without you getting at her.
    Go give her a hug
