I reported the matter to CAB who pass it on to Trading Standards. As promised, an update. Also waiting for my case with PayPal to be decided.
The reply from CAB:Your rights
Based on the information you have given you may be protected by the Consumer Rights Act. You will have legal rights if the item you bought is not of a satisfactory quality. You won’t have any legal rights if it was damaged by wear and tear, an accident or misuse, or you’ve just changed your mind.
As you bought the Mobile Phone less than 6 months ago, you don’t have to prove who caused the problem. If the seller says it is your fault, they must prove it; however, you might need to gather some evidence of the problem yourself. You can ask M***** ****** to repair or replace your Mobile phone. They shouldn't charge you for this and they should do it as quickly as possible.
Hope this helps anyone with a similar problem.
