  • What does the Newbies thread tell you to do about a debt collectors letter?
    Sorry, I didn't know this was called a debt collector letter. I thought these kind of letters were only sent by companies such as PCS but I've just read that BW Legal can also send these.
    I will just ignore them then.

    I haven't. I don't live in that place anymore. Do you think would be helpful to complain to my MP? How would I do that?

    Of course you should complain to your MP, the more people who complain, the more likely it is to hurt the  the scammer
    You never know how far you can go until you go too far.

  • In a previous post it was suggested to send letters before claim to the landowner,management company and UKCPM.
    I've followed the advice and tweaked the letters to my situation. In my case, I've rented the property from a letting agent. 
    I've prepared the letters for the management company and link parking.
    There's no landowner so regarding the landlord, should I just send the letter to his letting agency who signed the tenancy agreement on his behalf assuming they are 
    responsible?

    Ok, since it is the Management Agent who did the contract with Link Parking, and not the landowner, I will just send a letter to them and Link Parking I guess.
    1. Although the Managing Agent (according to them) instructed the Landlord to provide me with a parking permit but the landlord said he never received the communication. Shall I just leave him out of the equation?
    2. Should I send copies of my Tenancy Agreement to the Managing Agent and Link Parking?

    Always include the landowner and landlord if different.

    Yes, send both parties a copy of the tenancy agreement pointing out that you had primacy of contract at the time of the alleged event, and also tell them this will be reproduced at the exhibits/evidence stage should they proceed to court in order to show the judge the vexatious and unreasonable nature of the claim.

    Remind the scammers that a reasonable company would have ensured they had already obtained copies of the tenancy/lease to ensure they didn't try to override a resident's existing rights.

    The idea is to show how reasonable you are being and how unreasonable the scammers were by continuing to court even though they knew they didn't have a case.
