    If your ex wants his rent, or to sell, then you will have to leave.  Of course if you leave and rent elsewhere the taxpayer will contribute towards your rent.
    Were you married ? I suggest any equity in the  property would form part of the marital assets.  Have you formally divorced ?

    I really dont no what to do when the time comes as i dont want to leave the family home as im settled with my children. Its really hard in the area i live in to get a council house. Also not many people will take me on when on benefits. I was not married to my ex we were just cohabbting together so even if he decides to sell the house im not going get anything from the sale.

    It's highly unlikely that you'll be able to claim for help with the rent as has been previously advised. Is the house in your name as well as your ex's?

    The reason my ex is saying that that i can stay rentfree is bacause he knows i cant afford to pay it and not entitle to HB. He knows with UC rent payment criteria is differant. Could i not tell the DWP my story that this will not be a contrived tennancy but genniun.
    I understand as discussed on her i dont need to worry about going onto UC yet but i am in a lot of stress.

    They aren’t - not in this respect.

    Unfortunately it fits all the criteria of a contrived tenancy, so your situation will not change their mind. 

    Is he paying maintenance for his children, or is he letting you live there ‘free’ instead of that?

    Okay so if you ever did need to move out then get him to pay child maintenance instead of providing accommodation.

    Council houses are difficult to get almost anywhere, hardly anyone gives them up, often passing them to their kids.
