Scs settee

Hi guys hope someone can advice.
Purchase a new settee ( 2 seater +3seater)
Waited for build and took delivery on 22 October. But the 3 seater ( split back) had been made /assembled incorrectly, so I rejected delivery of the 3 seater and it was taken away. For repair ?
Of course they promised the world and the settee would be back within a few days
Today I recieved a call from them to say they want to re deliver the settee as the brackets have now been adjusted.?
Can I refuse delivery and instead insist on a refund . ?
