Reissue of Cheques

Last year I gave a cheque to my workplace in order to pay for some social clothing with the companies logo on and a silly slogan on the back...

This cheque was never banked by the company and now they are requesting that I reissue the cheque as it is over 6 months old.

Now i've looked around the internet and can't find any information other than that cheques are supposedly legal for 6 years but 'expire' after 6 months.

Am I actually required to pay this cheque now?

As far as I was concerned they had my cheque (as good as cash?) and the matter was over. Is this the case or am I legally required to reissue the cheque?

    You've got the goods ..... they don't have the money - so you work out the legality of it? A cheque is not 'as good as cash' - as they've proven by not tendering it.

    One could argue they have had 6 months to do it in .. so that's the end of the matter? But as you have to work with them - and they pay your wages, then keeping on the right side of them, for a small admin error and a few pounds, is probably a small price?

    Do they still have the cheque? If so, you can simply re-date it and initial (better to put your full signature if it's not too long) against the change.

    I had to chase people to re-issue cheques in work a few years ago for personal telephone calls. A member of staff had left and a stash of personal/business cheques was found in her draw. Some of the cheques were over 12 months old.I was given the task of collecting payment.

    I had to write to a couple of organisations and I emailed staff requesting payment. All but one member of staff paid up with no fuss after they had confirmed their cheques hadn't been cashed. I passed on the refusal to pay to our audit section who then took the matter up - they paid!

    Exactly what I was intimating with the 'admin error'. Like you - been there and done that - regrettably.

    Not usually ...... legal for 6 years - but not normally bankable after 6 months was, and remains, the guidance :-

    I've personally had cheques honoured by my bank that I sent over a year ago.

    No ! Cheques have a validity of 6 months.

    If a bank accepts a cheque (in error as many do not notice the date) there is no guarantee that cheque will clear as it can be refused during the clearing cycle. That's not to say that many do go through without problem.

    I was shocked and had to phone my bank as the cheques were from an old cheque book.

    When I phoned the bank they just said they could cash them, and perhaps they had been sat in someone's drawer for the past year.

    I'm sure there was a report on Watchdog or Light Lunch ( one of those type of progs anyway) and they were doing a report into cheques.

    Maybe it's just my bank?

    Maybe just the one individual - who gave you wrong information. The only time a bank cashier will accept a cheque over 6 months old .. is in the first few days of the New Year. When there's a general moratorium of 7-10 days on cheques dated Jan ... but with the wrong year on them (as people haven't got used to the year change) Other than that - the guidance provided by APACS (posted above) is followed
