I’m a entitled to furlough

So after handing my notice in it was agreed that my last day would be nov 7th, however I already had a holiday booked in for the week leading up to this date, meaning my last day at work would be fri 30th Oct. unfortunately the lockdown announcement came a day later, to which understandably my new employer has needed to defer my start date, as I wasn’t on there Oct payroll. The problem is my old employer is refusing to furlough me, and it has become apparent that they have put my finish date as fri 30th and not nov 7th. Where do I stand?

  • No one is entitled to furlough. I can understand why your old employer won’t do it. You have resigned.

    You've resigned.  Furlough is not a right. At the discretion of the employer.

    No one is entitled to furlough, some people are eligible, however furlough is at the discretion of the employer, and with a cost of around 15-20% of salary to the employer for most it may well be too costly.

    Details on rehiring:

    "2.4 Employees re-employed by their employer

    Employees that were employed and on the payroll on 23 September 2020 who were made redundant or stopped working for their employer afterwards can be re-employed and claimed for. The employer must have made a PAYE Real Time Information (RTI) submission to HMRC from 20 March 2020 to 23 September 2020, notifying a payment of earnings for those employees.

    Similarly, an employee who was on a fixed term contract, on payroll on 23 September, and that contract expired after 23 September can be re-employed and claimed for, provided that the other eligibility criteria are met."
