    Just to progress the discussion, wouldn't the neighbour have a strict liability for the escape of oil, as opposed to having to be proved negligent? i.e. he brought something on to his land which if it escaped would cause damage / injury to others. Rylands v Fletcher.
    Also, if the OP had Buildings AD cover this would be covered unless there was an exclusion relating specifically to escape of oil from a neighbours property. not sure what my policy says on this

    I saw TadleyBaggies repsonse. I didn't expect to help the OP as it would seem that their issue was resolved without explaining how.
    I was suggesting what the possible remedies may have been had somebody with the same problem googled it and been directed to this thread.
