I paid for my children's swimming lessons for the following term back in early March, just before the lockdown. All their swimming lessons were cancelled the week after I paid and haven't resumed and aren't looking likely to resume any time soon. I have emailed the swimming company to ask for a refund, but I just wondered what my rights are if they refuse to issue the refund? The reason for me wanting a refund is we are in the process of moving and it's looking very likely that we will have moved by the time the lessons resume. We will be moving to a different county, so it's not really an option for my children to still attend the lessons as we are moving 150 miles away.

You may be able to claim a refund if the contract was frustrated on the following basis:
- where time is 'of the essence'; or
- where the length or the extent of the delay amounts to frustration.

I've never had an agreement. The only thing I get is just about term dates and general information about the lesson. There's no cancellation details on there.0

What's the amount in question? If it's £50 or something, you will need to decide how far you want to pursue it. If it's a lot more, you could try a letter before action with the threat of small claims action.0

It's £250.0
