Chances of getting a refund

I paid for my children's swimming lessons for the following term back in early March, just before the lockdown.  All their swimming lessons were cancelled the week after I paid and haven't resumed and aren't looking likely to resume any time soon.  I have emailed the swimming company to ask for a refund, but I just wondered what my rights are if they refuse to issue the refund?  The reason for me wanting a refund is we are in the process of moving and it's looking very likely that we will have moved by the time the lessons resume.  We will be moving to a different county, so it's not really an option for my children to still attend the lessons as we are moving 150 miles away.

    What does the agreement say?

    You may be able to claim a refund if the contract was frustrated on the following basis:
    • where time is 'of the essence'; or
    • where the length or the extent of the delay amounts to frustration.

    I've never had an agreement.  The only thing I get is just about term dates and general information about the lesson.  There's no cancellation details on there.

    What's the amount in question?  If it's £50 or something, you will need to decide how far you want to pursue it.  If it's a lot more, you could try a letter before action with the threat of small claims action.
