i have become disillusioned with marriage and believe it is the cause of all the problems.  divorce is not actually the problem, but marriage is the source of the problem!  if we didn't get married and just lived together, we wouldn't have this headache of asset split when it comes to moving on.

i find it extraordinary that it is so easy to get married but so difficult to get divorced.  making a decision to leave the marriage is not entirely up to you but what the courts decide.
  • As others have said, anything you do will stink of you trying to get out of dividing your joint assets and i'm not sure why you would want to do that to the mother of your child.  Go see a solicitor and try to resolve this amicably or through mediation if you have to but sort it fairly.
  • Thanks everyone again for your input. Just to clarify I purchased the property well before we had our child.

Can someone clarify what a financial settlement document is? Does it need a solicitor? We are trying to keep our costs as low as possible.

You're certainly going to need mediation: that's cheaper than a solicitor, and if you can take an agreement to a solicitor that will certainly be cheaper than letting the solicitors slug it out from scratch.

I’m struggling to see how selling the property and gifting the money to niece/nephew is safeguarding it.
Smacks instead of doing everything possible  to prevent her getting any share, with no other reason behind the decision.

Cynically, are you (at least partly) trying to "keep it cheap" so she doesn't get much legal advice on the things/money which she may be entitled to?

There's information on financial settlements on gov.uk which you both may want to read.
