Abuse

I made a grievance a while back....    Been managed I don't see the said person with union putting weight on that.    I might have to deal with the person myself with knowbody around.  I am far from comfortable with this- Police were involved way back for guidance due to the nature of the circumstances.
I feel no option but go sick on this particular day to avoid the person as frankly I am stressed thinking about it.  I don't feel safe from physical attack and mental manipulation from the person.  CCTV is none bar coming in main door.
No time to seek union guidance as the weekend.
Surely the employer has a duty of care as they were well aware the impact on me.  So I find it bizarre this though some say said person might come in later just as I go off shift..  Not assuring for me having that MIGHT word. 
I am terrified.

    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!  
  • Why has that got to do with anything?  Mental illness a barrier to employment?  I merely asked for guidance here.  A grievance was issued that Police had to come in- time passed measured in months.  Union and employer agreed and I rested not to go forward even though legal was of the opinion I would get a non-disclosure due nature.   Too much stress.  Satisfied with the local remedy.
    Now it appears I might be head-on alone.  hoping a mistake nonetheless anxious.

    Could you not just put your mobile phone on record for 10 minutes and if he/she comes over says anything in an aggressive way, just advise them your phone is recording? 

    If nothing happens, you can just delete the recording after

    Was this person charged with any criminal offence? Or even cautioned? Just because the police were called doesn't in itself mean a crime was committed?

    Was the grievance upheld? If so, did the company take any disciplinary action? Or did the alleged conduct not justify any formal sanction?

    Been told to do this. Also, any feeling of I thinks I might be attacked. a person shouts or places me in a state of fear/alarm to 999.  Emailed union and the Solicitor that was dealing with this.  Yet again shoddy management and unbelievable i have not been told go half hour early to mitigate this.
    The employer does ave a duty of care found the paperwork from Solicitor. Was great as cited law-then applied what happened etc.  Wasa total dogs mess the grievance prces the professionals said-  my disability wasn't taking into account. List goes on.   But I just agreed the secure him not to be near me- fine.  But I reserved the right to cvil court for Interdict )injunction )if merited.   So work has indeed made this happen and been pointed out the person never seems to be themselves with a person in a room etc.
    I am on edge- Psychiatrsit provided in-depth report on how this person impacted on me prior to the incident.  But anybody can be a manager and it;s not regulated he said.  So it was more a move I think legally - might be wrong.  
    My work colleague is trying to juggle and come in to avoid this as they are disgusted.  So folk again are supportive just that doesn't remove fear of being abused/attacked

  • By adhering to the Health and Safety at Work 1992.   Equality Act 2010 was cited and another I can't recall by the law firm. The exchange of legal letters  stopped us from seeing each other since the event and has worked since.  Unfortunately, managers seem to lack insight and not until the solicitor letter lands on the legal dept desk things alter- thankfully.  But this is not reserved just for me I was told.
    See what happens and if I have any distress- made the union aware and the Solicitor that sorted the workplace out for me.   Hopefully seeing the person as the manager has not took 'reasonable precreations'(Scottish Law) I don't get so stressed I need medical help.

    You have mentioned quite extensively on many threads that you have a few quite severe mental health conditions. Is it possible that one of those conditions made you feel at risk of physical attack of manipulation when that maybe wasn’t quite the real version of events? The Equality Act is there to make things equal for everyone. They cannot use it to get rid of employees who make other employees feel at risk of physical attack when the actual
    risk of an attack isn’t present.

    You work a lot of hours, and you have posted very recently about suicide on here. Many people before me have said it may be a good idea to see if your work is helping or hindering your mental health

    Which hasn't been answered. I can only assume the police took no action because they felt the alleged behaviour didn't amount to a crime. Equally (correct me if I am wrong) the employer took no disciplinary action but instead opted to try and keep the individuals apart. 

    The employer has a duty to treat both employees fairly, something the OP seems unable to accept.

    Yeah exactly. I can’t understand why unions, solicitors and police involvement just ended with ‘stay away from each other’ which is more akin to a school playground resolution. 

    The posts are getting increasingly hard to follow and there are some quite unusual posts elsewhere on the forum too. I do think professional mental health intervention is needed...
