So backstorySo I have 1 defaulted account with Virgin media (was a mobile account), defaulted in 2018 but account was taken out in 2012 payments were stopped in 2012/2013.
Second Virgin account hasn't been defaulted, taken out end of 2011, they just keep reporting 6 months late.
Ive written and requested a copy for both accounts of a CCA and statement of accounts, I sent the £1 cheques and they cashed them both.
I heard nothing so sent another letter to ask them to respond and they didn't, it was signed for posted.
As no response I then wrote to 4 different addresses I found requesting the information including proof of the above and they rejected 2 letters and signed the other 2.
Ive put an official complaint in, signed for postage (only received last week tho)
Ive contacted Equifax for both accounts and the response from virgin was the information is correct please contact customer service to discuss, I have 4 times and they can find no accounts under my name and address.
I have also sent a SAR letter including the £10 which hasn't been cashed yet.
Ive contacted ICO but they said it will be 3 months before they can look at it, FCO have said 8 weeks from the official complaint before they can look at it.
I got advice on here to wait for the official complaint to elapse 8 weeks and contact CISAS.
So today got through to someone who managed to find the account which is running 6 months late for the last 7+ years, balance is £533 now im wanting to get a mortgage in principal around March/April time. Mortgage advisor said this is going to stop me being able to get a mortgage as it needs to be settled or defaulted when it should have been (so would be off my credit file).
Would you continue to fight to get dates corrected or pay it then fight?
Ive not had any letters from virign yet and im worried if I don't pay it and they don't communicate I wouldn't be able to resolve it and not be able to get my mortgage, what would you do? Thanks

If you want the mortgage, you pay it and sort out the default markers later.0

Just for clarity if I pay it can they default it after? as in give me a default but date it 7 plus years ago?
Mortgage advisor said it needs to be settled at least 6 months so its a bit tight, I know its statued barred which is annoying lol0 -
Pay it since you owe it0

CCA does not apply to mobile accounts, only agreements covered by the consumer credit act, so you will have a long wait. Also its more than likely the debts have been sold on, or are dormant, which is why they cannot find them.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
