do not pay it.Smart parking? in whose car park? From the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"2 -
do I seek legal advice or pay it ?Neither at this stage. Wait to see if a claim in the Sheriff court is issued. Unless you've inaccurately described the letter you've received, it's not one of those. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hello, I received two from the same mob today. CST Law. Mine both said "Letter Before Claim" as a header. Do yours say the same? You merely adopted the PCN. I was born in it, molded by it. I didn't see this forum until I was already a man.1

fookit said:Hi , I received a letter from CTS Law about a parking ticket said there client smart parking ltd has asked them to reclaim debt . The advice for all agencies are English and i live in Scotland and the carpark is Scotland , do I seek legal advice or pay it ?Thanks
CST, what can we can we say about this lot. They clearly have not heard that Pete Wishart, a Scottish MP, considers Smart Parking as criminals in Scotland.
As long as you do not name the driver, CST will be left with egg on their faces just as happened in England
In a nutshell, CST think you are a mug ... are you ?

these companies are skint, especially due to covid affecting their incomethey jave mountains of unpaid "invoices" masquerading as PCN,sso in a covid environment , what would you do ?yep , thats rihgt , go through the backlog and try and frighten people into paying up, with half truths , smoke and mirrors, pass them to a no win , no fee contractor who send out "oooh scary" letters !if the driver has been revealed , then maybe they would have some substanceif they are for eye watering sums, they may take a punt, as we have seen today on here, think Carly Mackie0

You all just need to read the CST group thread - no need for more (please). We made a group thread to avoid this.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's interesting you know, VCS took Carly Mackie to court and despite them winning, she went bankrupt. which was the right thing to do. What did VCS get from it, very little if anything but it cost SRS a lot.
Will Smart be stupid enough to throw money when the outcome could be £0
No doubt Smart is on the bucket list in Scotland as in England and Wales to be banned from the DVLA1 -
Read what Pete Wishart MP said recently in the House of commons about Smart Parking.
"I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.
…
The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices.
