Money Moral Dilemma: Should we pay for a fence panel that was supposed to be free?

  • Your neighbour was obviously trying to be helpful but they should have waited until you returned from your short break, did the gentleman tell them it was going to cost £50 to deliver? If it had fitted and was a new panel it would have been worth the £50, but it didn't and that is not your fault or responsibility. It is up to your neighbours to sort it out, especially as they work with this chap. You still have to replace the fence panel so why would you also pay £50 for nothing??
  • No, absolutely not. My husband owns a fencing company and he only charges £35 to supply, deliver, drop the panel in and take the old one away! Plus you never agreed to pay so you are not obliged.

    My "poor pensioner" (not) neighbour has conned their three neighbours into paying to fence their entire back garden on each side. I didn't care too much because I got the fence I wanted but they still tried to interfere with the workmen I was paying until I got the title deeds out and shut them up. Believe me £50 is no big deal but why isn't the neighbour dealing with it?

    Who did the measurements for this fence?
    If it was the neighbour then they are liable - if it was the person who put it up and said it was the wrong size then they are liable.
    You were told it would be free so in theory I would say you don't need to pay. But you didn't do the measurements so it's not your fault.
    What about paying half each? Though that would probably still cause dischord regardless of the person casual in measuring it.
    Sounds as though the neighbours damaged it and why they were in so much of a hurry to replace YOUR fence.
    I had skilled men to replace fence panels where one didn't fit. It's not always as easy as slotting one in.

  • I'm confuddled . They said they could get one for free , If it fitted fine no problem no charge to you (or them) because it doesn't fit they expect £50 rips for no fence installed . 
  • Check the deeds to see who's responsible,hopefully they are(neighbours),end of.If you are then tell the bloke with the panel to go away as you never arranged it with him or let them know they can have a total of £50 when they fit a new panel.Or you go and buy a new panel for about £24 and fit it yourself.Deeds first.
  • say you wont pay for the fence but you've bought them a tape measure to show good will.

    It's rather irritating when people go back on their word but, regardless of whose responsibility it is to replace the panel as deeds are rarely helpful in terms of boundary liability, why not go halves with your neighbour? We're only talking about £25 and, with a bit of adjustment, I'm sure the panel can be made to fit. Depends what kind of panel it is, but if it is open lap it doesn't matter which side you use, as they're both the same. There's often no difference with close-boarded, either.
